Health Vault is a personal health data management platform that allows you to:

  • Upload, store, and organise medical records and health documents.
  • Receive AI-assisted analysis and insights based on your health data.
  • Track health metrics and biomarkers over time.
  • Generate health reports and share data with healthcare providers.

3. Medical Disclaimer

IMPORTANT: Health Vault is NOT a medical device and is NOT regulated as such under UK MDR 2002 or the Medicines and Healthcare products Regulatory Agency (MHRA) guidelines.

  • The Service does not provide medical diagnoses, treatment recommendations, or clinical advice.
  • AI-generated insights are for informational purposes only and must not be used as a substitute for professional medical advice, diagnosis, or treatment.
  • Always consult a qualified healthcare professional regarding any health concerns or before making health-related decisions.
  • In a medical emergency, call 999 or go to your nearest A&E department immediately.

4. Eligibility

You must be at least 16 years old to use the Service. If you are under 18, you confirm that you have obtained parental or guardian consent.

5. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate and up-to-date information.
  • You must notify us immediately of any unauthorised access to your account.
  • You are responsible for all activities under your account.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Upload content that infringes third-party intellectual property rights.
  • Attempt to gain unauthorised access to any part of the Service.
  • Use the Service to store data about other individuals without their consent.
  • Reverse-engineer, decompile, or disassemble any part of the Service.

7. Intellectual Property

All intellectual property rights in the Service (excluding your personal data) belong to Vert Neo Limited or our licensors. You retain ownership of any data you upload to the Service.

9. AI-Powered Features

The Service uses artificial intelligence to process and analyse health data. You acknowledge that:

  • AI outputs may contain inaccuracies and should be verified by a healthcare professional.
  • AI processing involves sending data to secure third-party AI service providers under strict data processing agreements.
  • You may opt out of AI features at any time through your account settings.

10. Service Availability

We aim to provide continuous access to the Service but do not guarantee uninterrupted availability. We may suspend access for maintenance, updates, or circumstances beyond our control. We will endeavour to provide advance notice of planned outages.

11. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" without warranties of any kind.
  • We are not liable for any indirect, incidental, special, or consequential damages.
  • Our total liability shall not exceed the amount you have paid for the Service in the 12 months preceding the claim.
  • Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

12. Consumer Rights

If you are a consumer, you have statutory rights under the Consumer Rights Act 2015 that are not affected by these Terms. The Service must be provided with reasonable care and skill.

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer in Scotland, you may also bring proceedings in Scotland; if in Northern Ireland, in Northern Ireland.
